Terms and Conditions applicable to customers for opening and using a digital wallet on the MIO3 platform
MIO3 is a corporation (Sociedad Anónima de Capital Variable), abbreviated as MIO3, S.A. de C.V. (“MIO3”), duly incorporated under the laws of the Republic of El Salvador, with registry entry No. PSAD-0016 in the Definitive Registry of Digital Asset Service Providers, dedicated to providing Digital Asset services. MIO3 is authorized by the National Commission of Digital Assets of El Salvador to act as a digital asset service provider under Article 19 of the Law on the Issuance of Digital Assets and to offer custody services as well as the opening and use of digital wallets, which meet industry standards for security and service level. Definitions
- Applicant: A natural or legal person who requests the creation and registration of a user account on the Platform.
- User: The Applicant or any natural or legal person who has a registered account on MIO3’s Platform.
- MIO3: A digital asset service provider, domiciled in San Salvador, El Salvador, with headquarters in Antiguo Cuscatlán, Department of La Libertad, authorized by the National Commission of Digital Assets of El Salvador under registry No. PSAD-0016.
- Acceptance: The User’s and/or Visitor’s tacit or express manifestation of will regarding these Terms and Conditions of Use.
- Digital Wallet: An electronic device that enables transactions through the exchange of digital asset units and book-entry money; also referred to as a “wallet.”
- Digital Asset: A digital representation that can be stored and transferred electronically using a distributed ledger technology system, or similar or analogous technology, in which records are linked and encrypted to protect transaction security and privacy.
- Token: A digital asset used as a unit of account on a network, based on distributed ledger technology or similar/analogous technology.
- KYC: The know-your-customer process MIO3 performs before opening an account for Visitors, requesting the information necessary to verify identity and comply with applicable laws and regulations.
- Secondary Market for Tokens: The secondary market for buying and selling digital tokens, increasing liquidity and enabling investors to realize short-term capital gains.
- Digital Asset Exchange Service: A service where users can buy, sell, and exchange tokens in a digital and reliable environment.
- Digital Asset Custody Services: Custody services for digital assets, ensuring the security and protection of tokenized investments.
- Digital Portfolio Management Service: A service where MIO3 monitors and manages investments in tokenized assets, with advanced analytics tools and real-time reporting.
- KYB: The know-your-business process MIO3 performs before opening an account for Visitors, verifying the existence and credentials of the applicant entity and the identity/authorization of the person who manages the User and the company’s Digital Wallet.
- Platform: MIO3’s website and mobile application.
General Provisions
2.1. Contractual Relationship: These Terms and Conditions for custody, opening, and use of a digital wallet on the MIO3 platform (“Terms and Conditions”) constitute a legal agreement and a binding contract between the User and MIO3. They govern the use of services available on the MIO3 Platform, which may be provided by MIO3 or any affiliated entity.
2.2. These Terms and Conditions do not encompass all the rights and obligations governing the relationship between the User and MIO3. Together with the Website Terms of Use, Privacy Policies, and any other agreements or contracts entered into between MIO3 and the User, they constitute the User’s full set of obligations, rights, and conditions.
2.3. Changes to the Terms: MIO3 reserves the right to change and/or modify these Terms and Conditions and will indicate on the Platform the date of the Last Review. All changes will take effect upon publication of the latest version on the Platform. Continued use of the digital wallets and the Platform after the updated version takes effect will be deemed acceptance of the new Terms and Conditions.
Registration and Requirements for MIO3 Users
3.1. Registration: Natural and legal persons must register and create a User on the Platform to access a Digital Wallet. The Applicant must complete a user creation form and then a customer information form that varies according to the account type: (i) natural person or (ii) legal person. MIO3 may, at its sole discretion, deny the opening of a User account to any Applicant. Before confirming the account opening, MIO3 will request additional information to complete the corresponding KYC or KYB. Once all information is provided, MIO3 will send an email within a maximum of ten (10) business days confirming or denying the opening. MIO3 reserves the right to request additional information even after confirmation.
3.2. Eligibility: For a User to open a MIO3 Wallet, if a natural person, they declare to be at least 18 years old (or the legal age to contract in their jurisdiction) and to have legal capacity to accept these Terms. For legal persons, the authorized person declares and warrants they have the legitimacy, capacity, and documentation to represent and bind the entity to these Terms, as well as the necessary authorizations to access and use the Digital Wallet on behalf of the entity. The entity is duly incorporated under its country’s laws. The User’s use of the Wallets will not violate local, international, or applicable regulations. Prohibitions include: (i) having been previously suspended or removed from the Platform; (ii) already having an active account; (iii) residing, being incorporated, or otherwise established in a jurisdiction where accessing or using the services is prohibited or would cause MIO3, affiliates, or third parties to contravene legal regulations.
3.3. User Identity Verification: By accessing the Platform, the User accepts that the provided information will be used by MIO3 for verification and validation for the creation or continued use of the account and to prevent activities related to terrorism financing, fraud, or any financial crime. The User also accepts that MIO3 will keep a record of the provided information while the account and Digital Wallet are active and for five (5) years after closure. The User guarantees the information is truthful and complete and is solely responsible for keeping it updated and confidential. If MIO3 detects inconsistencies or potential incorrect/false/outdated information, it may suspend the User’s account and Wallet usage, notifying via the User’s designated email. MIO3 may give an opportunity to remedy; otherwise, MIO3 may cancel the account.
3.4. Only the registered User may access the Digital Wallet. MIO3 reserves the right to suspend or cancel Digital Wallet use under these Terms and other policies. If the User suspects or becomes aware of any unauthorized use, they must notify MIO3 immediately. MIO3 assumes no responsibility for any loss or damage arising from unauthorized access.
3.5. As custodian of Users’ Digital Wallets, MIO3 commits to maintain their security by implementing industry standards. The User commits not to share access credentials or confidential information with any third party and accepts sole responsibility for taking security measures to prevent disclosure.
License
4.1. MIO3 provides a revocable, non-exclusive, non-transferable, sublicensable, and limited license. Using MIO3’s Services, Platform, or Digital Wallets for commercial purposes or resale is prohibited. If MIO3 suspects such activities, it will deem them a breach of these Terms and may freeze the account’s activity and Digital Assets until proven otherwise. The license only allows access to and use of the Platform; no intellectual property ownership or rights are transferred.

The User must keep contact details correct and updated; otherwise, MIO3 will not be responsible for non-receipt of communications.
Conditions for Use of the Digital Wallet
5.1. A User with an active account may use the services offered by MIO3 in accordance with these Terms and other usage policies.
5.2. To ensure compliance with legal restrictions and anti-money laundering policies, Digital Debt Assets may not be transferred by the User without MIO3’s consent. All transactions conducted on the Platform through MIO3 digital wallets are subject to authorization by MIO3 in its custodial role.
Information about the MIO3 Account
6.1. To access services offered through the Platform, the User must create and maintain an active MIO3 account (natural person or legal person as applicable). All accounts are confirmed at MIO3’s sole discretion; MIO3 may reject any Applicant.
Sole Beneficiary
7.1. If the User is a natural person, they guarantee and undertake to use the account for themselves and not on behalf of a third party, unless they have prior written authorization shared with MIO3.
7.2. If the User is a legal person, the authorized users guarantee and undertake to use the account solely for the benefit of the entity and not on behalf of a third party, unless they have prior written authorization shared with MIO3.
7.3. The User is solely and exclusively responsible for the activity that occurs under their MIO3 account.
7.4. The User must comply with identity verification procedures before account confirmation and access to services. All information provided must be truthful, complete, accurate, and updated upon any change. The User authorizes MIO3 to verify the information directly or through third parties to prevent fraud, identity theft, money laundering, terrorism financing, and related crimes. The User allows MIO3 to share the information with identity verification agencies, compliance data registries, credit reference agencies, fraud or financial crime prevention entities to validate such information.
7.5. The User must satisfy KYC or KYB procedures, as applicable.
User Funds
8.1. Users’ funds will be kept separate from MIO3’s corporate funds, in a bank account exclusively for such funds, with a banking partner duly authorized to perform such activity.
8.2. MIO3 will keep Users’ account statements and balances updated for consultation via the Platform.
8.3. Banking partners are evaluated by MIO3 to verify necessary authorizations and compliance; however, MIO3 will not be liable for the insolvency of banking partners holding Users’ funds.
Custody of Assets
9.1. MIO3 will record, store, and preserve the User’s Digital Assets appropriately to safeguard and control those assets.
9.2. MIO3 will not pay interest on the User’s Digital Assets.
9.3. Users’ Digital Assets are recorded in each User’s respective account.
9.4. MIO3 will keep records of Users’ Digital Assets updated for consultation through the Platform at all times.
Account Information and Transaction Records
10.1. The User may access their account history at any time on the Platform. The User must review it carefully and inform MIO3 if they consider it incorrect within five (5) calendar days from the date MIO3 provides or makes the statement available.
10.2. MIO3 may correct any error in the User’s account history and reserves the right to void or reverse any transaction arising from a manifest error, or modify the transaction details to reflect, in MIO3’s judgment, the true conditions of the transaction.
10.3. The User agrees that MIO3 may share their account information and history with entities that under applicable law may require MIO3 to disclose such information.
Account Security
11.1. The User is responsible for taking appropriate measures to protect their hardware and data from viruses and malware, as well as any inappropriate material. Except as required by applicable law, the User is solely responsible for backing up and maintaining duplicate copies of any information stored or transferred through MIO3’s services. MIO3 is not responsible for any claim or loss arising from the User’s failure to comply with this clause.
11.2. At all times, the User and any authorized persons must maintain adequate security and control of all Access Identifiers. The User is solely responsible for adopting necessary security measures (or ensuring authorized persons adopt them) to protect their MIO3 Account and keep their access identifiers secure, which includes: strict compliance with mechanisms/procedures established by MIO3; creating a secure password and safeguarding access IDs; keeping the email account and phone number provided to MIO3 up to date to receive alerts; not allowing remote access or sharing their computer/screen with third parties while logged in; and logging out after each session.
11.3. The User must promptly notify MIO3 if they know or suspect that their account security or that of an authorized person has been compromised or if there has been unauthorized use.
Closing the MIO3 Account
12.1. The User has the right to close their MIO3 account at any time by following MIO3’s cancellation procedures. MIO3 will not charge for cancellation, although any amounts owed to MIO3 must be paid. The User authorizes MIO3 to cancel or suspend any pending transaction at cancellation and to deduct any amount owed from the MIO3 account.
12.2. Notwithstanding the foregoing, the User may not cancel their MIO3 account if: they are attempting to evade an investigation; they have a pending transaction or open dispute; there are outstanding amounts owed to MIO3; or the account is subject to a freeze, hold, limitation, or reserve. The foregoing list is illustrative, not exhaustive.
12.3. MIO3 may cancel the User’s account for any reason and at any time if it considers that these Terms, established policies, or applicable law have been infringed. MIO3 may notify the User in advance of the closure and the reason for the decision.
12.4. Upon closure, the User must withdraw all Digital Assets in their MIO3 account and stop using MIO3’s services. If the User does not withdraw, MIO3 may, at its sole discretion and without notice: mark the MIO3 account as inactive; transfer such inactive account (including Digital Assets) to another MIO3 affiliate, any third-party custodian, or an isolated wallet when reasonably necessary, in which case the User will be entitled to recover their Digital Assets subject to reasonable verification requirements; charge a monthly inactive account fee to cover maintenance costs (deducted directly from the inactive account); and close an inactive account at any time.
12.5. Once an inactive account is closed, it cannot be reactivated and the User must register a new MIO3 account to continue using the Services. MIO3 will have no obligation to pay any rewards, incentives, or interest that might have been agreed to be paid to the inactive account regarding the Digital Assets credited to it.
Compliance with Local Laws
13.1. It is the User’s responsibility to comply with local laws regarding the legitimate use of MIO3’s services and Platform. The User must also comply with their local tax regulations and provide relevant information to their tax authority. All Users acknowledge and declare that their funds come from a legitimate and lawful origin; Users accept that MIO3 may require information on the source of funds and will collect such information and supporting material when used for this purpose. MIO3 will cooperate with competent authorities locally and globally to comply with anti-money laundering regulations.
Fraud
14.1. In cases of fraud or unauthorized charges on the User’s account, the User must immediately inform MIO3 at support@mio3.io. To improve the User experience, MIO3 will retain personal information and documentation for the legally required periods, provided under the contractual relationship between the User and MIO3.
14.2. Acceptable Use Policy: Use the content and services offered through this Platform exclusively for their stated purpose. The following are prohibited:
- Publishing, sending, uploading, presenting, displaying, or disseminating any information or material, or engaging in any conduct that is illegal, discriminatory, harassing, defamatory, abusive, threatening, harmful, offensive, obscene, tortious, or otherwise objectionable.
- Displaying, uploading, or transmitting material that encourages conduct that may constitute a criminal offense, result in civil liability, or otherwise violate any applicable law, regulation, or rule.
- Interfering with or violating legal rights (such as privacy and publicity rights).
- Violating any applicable law or regulation.
- Using this Website or the links contained herein in any way that may interfere with, disrupt, negatively affect, or inhibit other users from using the Website or its links, or that may damage, disable, overburden, or impair the operation of the Website, our servers, or any network connected to our servers.
- Creating a false identity to deceive others or fraudulently representing oneself as another person or a representative of another entity, including but not limited to an authorized user of this Website or a representative of MIO3, or fraudulently claiming an affiliation.
- Deceiving our representatives or third parties who may rely on the information provided by you by supplying inaccurate or false information, including omissions.
- Disguising the origin of any material transmitted through the services provided by this Website.
- Violating, infringing, or misappropriating any person’s intellectual or industrial property rights, such as copyrights, trademarks, patents, trade secrets, or other proprietary rights, including MIO3’s.
- Uploading files that contain any kind of virus, malware, corrupted files, or other similar software/programs that may damage another person’s computer or property; MIO3 reserves the right to accept only .pdf, .jpg, and .png formats.
- Sending, uploading, displaying, disseminating, or making available material associated with spam, junk mail, pyramid schemes, chain letters, virus warnings (without first confirming authenticity), or any other unauthorized advertising or promotional material.
- Accessing any content, area, or functionality of this Website where access is prohibited or restricted, or attempting to circumvent measures used to prevent or limit access.
- Obtaining unauthorized access to or interfering with the performance of the servers hosting this Website or providing services on this Website or any server on any associated network, or otherwise failing to comply with policies/procedures related to the use of those servers.
- Attempting to gain unauthorized access to any service or product, other accounts, computer systems, or networks connected to any of our servers through hacking, password mining, or other means.
- Obtaining or attempting to obtain materials or information through any means not intentionally made available through this Website or its services.
- Collecting data about others, including email addresses, whether in aggregate or otherwise, and/or distributing or selling such data in any way.
- Using any part of this Website for purposes other than its intended purpose.
- Using this Website to engage in or promote any activity that violates these terms.
Liability
15.1. There may be interruptions, delays, errors, or security issues. MIO3 will not be liable for damages arising from misuse or the inability to use MIO3’s Services, including but not limited to property damage, economic loss, or data loss. The User understands and agrees that MIO3 will not be liable for losses or damages arising from or related to: defects or omissions in digital asset price data; errors or delays in data transmission; data interruptions; service changes resulting from scheduled or unscheduled maintenance by MIO3 (previously notified); damage incurred due to actions, omissions, or breaches of these conditions by other users; damage caused by illegal actions of third parties or actions without MIO3’s authorization; or force majeure/acts of God. In cases of correct use of the services, MIO3’s liability is limited to the amount of fees and charges for the use of MIO3’s services.
15.2. The waiver or limitation of liability in these Terms may not apply to the extent prohibited by the applicable law in the user’s jurisdiction of residence.
Direct Resolution
16.1. In case of disputes, the User should preferably contact MIO3 directly to discuss disagreements and seek a solution. If unresolved, the following clause will apply.
Jurisdiction and Governing Law
17.1. These Terms will be governed by and construed in accordance with the laws of the Republic of El Salvador. Any dispute or claim related to these Terms will be resolved exclusively in the competent courts of the Republic of El Salvador.
Severability
18.1. If any clause of these Terms becomes or is deemed illegal, invalid, or unenforceable, it shall be treated as unwritten or modified to be enforceable, without affecting the legality, validity, or enforceability of the remaining clauses.
Language
19.1. These Terms may be translated into other languages. Such translations are for information purposes; in case of inconsistency or ambiguity in interpretation, only the Spanish version shall prevail.
Notices
20.1. MIO3 will send notices only to the email address the user provided when registering the account. It is the user’s responsibility to ensure the email is correct and up to date. Notices will be deemed valid when received at the provided email address.
Account Handling in the Event of the User’s Death
21.1. In the event of the death of the MIO3 account holder, the provisions of El Salvador’s Civil Code regarding succession shall apply, only with respect to digital wallets held in custody by MIO3.
Acceptance of the Terms and Conditions of Use
By accepting these Terms, you acknowledge that you have read and understood their content and agree to be bound by them as established in Article 14 of the Electronic Commerce Law. If you do not agree with these Terms or cannot comply with them, you will not be able to use MIO3’s Services or access any content.
These Terms govern the relationship between you and MIO3. They do not create rights in favor of third parties. If you fail to comply with these Terms and MIO3 does not take immediate action, this does not mean that MIO3 waives any rights it may have (such as taking action in the future).

Terms and Conditions applicable to users seeking tokenized project financing and issuing their digital assets on the MIO3 platform
MIO3 is a corporation (MIO3, S.A. de C.V., “MIO3”), duly incorporated under the laws of the Republic of El Salvador, authorized by the National Commission of Digital Assets of El Salvador with registry No. PSAD-0016 in the Definitive Registry of Digital Asset Service Providers to act as a digital asset service provider under Article 19 of the Law on the Issuance of Digital Assets, and to offer services for subscription, risk assessment and pricing of digital asset issuances, as well as to promote, structure, and manage all types of investment products in digital assets. Definitions
- Applicant: A natural or legal person who requests the creation and registration of a user account on the Platform.
- User or Issuer User: The Applicant or any natural or legal person with a registered account on MIO3’s Platform for the purpose of carrying out issuances of digital assets tradeable on the MIO3 Platform.
- MIO3: Digital asset service provider domiciled in San Salvador with headquarters in Antiguo Cuscatlán, authorized under No. PSAD-0016.
- Acceptance: Tacit or express manifestation of will regarding these Terms.
- Digital Asset: A digital representation that can be stored and transferred electronically using distributed ledger technology or similar/analogous technology.
- Token: A digital asset used as a unit of account on a network.
- Tokenization of Real-World Assets: The process of transforming real-world assets and securities (e.g., real estate and debt) into digital assets.
- KYC: Know-your-customer process.
- Tokenized Project Financing Service: Alternative financing solutions through the issuance of Digital Tokens.
- Digital Asset Issuance Services: Public or private issuance of Tokens pursuant to the laws of the Republic of El Salvador.
- KYB: Know-your-business process.
- Platform: MIO3’s website and mobile application.
General Provisions
2.1. Contractual Relationship: These Terms and Conditions constitute a Legal Agreement and Binding Contract between the User and MIO3, governing the services available on the Platform, provided by MIO3 or its affiliates.
2.2. These Terms do not cover the totality of rights and obligations; together with the Website Terms, Privacy Policies, and other agreements, they comprise the User’s full conditions.
2.3. Changes: MIO3 may change/modify these Terms and indicate the Last Review date on the Platform. They take effect upon publication; continued use implies acceptance.
Registration and Requirements
3.1. Registration: Natural or legal persons must register and create an Issuer User. Forms will be completed according to account type (natural or legal). MIO3 may deny at its discretion and request additional information for KYC/KYB. Confirmation or denial will be notified within ten (10) business days; more information may be requested even after confirmation.
3.2. Eligibility: The Issuer User (natural person) declares legal age and capacity. For legal persons, the authorized person declares legitimacy, capacity, and documentation to represent and bind the entity, has signed all required agreements for digital asset issuance/tokenization, and holds necessary permissions from the competent local authority when applicable. Prohibitions include: prior suspension/removal; existing active account; prohibited jurisdiction; not having signed required contracts; lacking authorization from the competent governmental institution, if applicable.
3.3. Verification: The User accepts use of their information for verification/validation, prevention of financial crimes, and record-keeping while the account is active and for five (5) years after closure. False/inconsistent/outdated information may lead to account suspension, freezing of issued Digital Assets, suspension of transactions, and wallet use; notification will be sent by email. If not remedied or impossible to remedy, MIO3 may cancel the account.
3.4. Only the registered User may access the Platform. MIO3 may suspend/cancel use in accordance with these Terms and policies. The User must notify unauthorized use. MIO3 assumes no responsibility for losses/damages from unauthorized access.
3.5. MIO3 commits to keep accounts secure by implementing industry standards; the User must not share credentials or confidential information and is responsible for protecting access.
License
4.1. Revocable, non-exclusive, non-transferable, sublicensable, and limited license. Use for commercial purposes or resale is prohibited. Upon suspicion, MIO3 may freeze activity and assets. The license does not transfer ownership or intellectual property rights.

Limitations on Issuance and Tokenization Services
5.1. The Issuer acknowledges that the issuance and successful placement of digital assets depend on factors external to MIO3 (market conditions, regulatory authorizations, legal restrictions, etc.); MIO3 does not guarantee placement or subscription.
Anti-Money Laundering Policies
6.1. To ensure compliance with legal restrictions and AML policies, Digital Assets from an issuance may not be transferred by the User without MIO3’s consent. Every transaction will be subject to authorization by MIO3 as custodian.
Information about the MIO3 Account
7.1. To access services, the User must maintain an active MIO3 account (natural or legal). Account confirmation is at MIO3’s discretion.
Sole Beneficiary
8.1. Natural person: will use the account for themselves; third-party use only with prior written authorization shared with MIO3.
8.2. Legal person: authorized users will use the account solely for the entity’s benefit; third-party use only with prior written authorization.
8.3. The User is exclusively responsible for all activity under their account.
8.4. Identity verification must be completed prior to confirmation; information must be truthful/complete/accurate and kept updated. MIO3 may verify directly or via third parties and share with identity verification, compliance, credit reference, fraud prevention, or financial crime agencies.
8.5. KYC or KYB must be satisfied as applicable.
User Funds
9.1. User funds are segregated from MIO3’s funds, held in a dedicated bank account with an authorized partner.
9.2. Statements and balances will be kept updated for consultation via the Platform.
9.3. Banking partners are evaluated by MIO3; MIO3 is not liable for their insolvency.
Custody of Assets
10.1. Proper registration, storage, and preservation of Digital Assets.
10.2. No interest is paid on Digital Assets.
10.3. Assets are recorded per User account.
10.4. Records are kept up to date for User consultation.
Account Information and Transaction Records
11.1. Access to account history at any time. The User must review and report errors within five (5) calendar days of availability.
11.2. MIO3 may correct errors, void/reverse transactions arising from manifest error, or modify details to reflect true conditions.
11.3. The User accepts that MIO3 may share account information/history with entities legally empowered to require it.
Account Security
12.1. The User is responsible for protecting hardware/data and keeping backups. MIO3 is not responsible for losses due to non-compliance with this clause.
12.2. Maintain security/control of access identifiers, including compliance with MIO3 mechanisms, strong passwords, up-to-date contact details, no remote access or screen-sharing while logged in, and logging out after each session.
12.3. Notify MIO3 promptly upon knowledge or suspicion of compromised security or unauthorized use.
Closing the MIO3 Account
13.1. Right to close the account following procedures; no fee, but outstanding amounts must be paid. MIO3 may cancel/suspend pending transactions and deduct amounts owed.
13.2. The account may not be canceled if: attempting to evade an investigation; a transaction is pending or a dispute is open; amounts are owed to MIO3; or the account is subject to a freeze/hold/limitation/reserve. Illustrative, not exhaustive list.
13.3. MIO3 may cancel the account for any reason and at any time upon breaches of Terms, policies, or law, and may notify the User with reasons.
13.4. Upon closure, the User must withdraw all Digital Assets and stop using the services. If not withdrawn, MIO3 may: mark the account as inactive; transfer it (including assets) to an affiliate/third-party custodian/isolated wallet; charge a monthly inactive account fee; and close the inactive account at any time.
12.5. An inactive account that is closed cannot be reactivated; the User must register a new account. MIO3 has no obligation to pay any rewards/incentives/interest previously agreed for inactive accounts.
Compliance with Local Laws
13.1. The User is responsible for complying with local laws regarding the legitimate use of MIO3’s services/Platform, considering local tax regulations and providing information to tax authorities. Users declare the lawful origin of funds, accept MIO3’s right to request/source-of-funds information, and MIO3’s cooperation with authorities for AML compliance.
Fraud
14.1. In case of fraud or unauthorized charges, promptly inform MIO3 at support@mio3.io. Personal information and documentation will be retained for legally required periods.
14.2. Acceptable Use Policy: Use the Platform only for its intended purpose. The following are prohibited:
- Publishing/disseminating illegal, discriminatory, harassing, defamatory, abusive, threatening, harmful, offensive, obscene, tortious, or otherwise objectionable material or conduct.
- Transmitting material that encourages conduct constituting a criminal offense, civil liability, or violation of laws/regulations.
- Interfering with or violating legal rights (privacy/publicity).
- Violating any applicable law/regulation.
- Using the Site or links in ways that interfere with or negatively affect other users or the operation of the Site/servers/networks.
- Creating a false identity or impersonating others/representatives (including MIO3) or falsely claiming affiliation.
- Providing inaccurate/false information or omissions to deceive.
- Disguising the origin of material transmitted.
- Violating/infringing/misappropriating intellectual/industrial property rights.
- Uploading files with viruses/malware/corrupted files; MIO3 accepts only .pdf, .jpg, and .png formats.
- Sending/dispensing spam, unauthorized advertising, pyramid schemes, chain letters, unverified virus warnings, etc.
- Accessing restricted content/areas/functions or circumventing measures restricting access.
- Obtaining unauthorized access to or interfering with servers/services/associated networks.
- Attempting unauthorized access to services/products, accounts, systems, or networks (hacking, password mining, etc.).
- Obtaining or attempting to obtain materials/information by means not intentionally made available.
- Collecting data about others (including emails) and/or distributing or selling such data.
- Using any part of the Site for purposes other than intended.
- Using the Site to engage in or promote any activity that violates these terms.
Liability
15.1. Interruptions, delays, errors, or security issues may occur. MIO3 will not be liable for damages arising from misuse or inability to use the Services, including property damage, economic loss, or data loss. MIO3 will not be liable for losses/damages related to price data defects/omissions, transmission errors/delays, data interruptions, service changes due to scheduled/unplanned maintenance (previously notified), actions/omissions/breaches by other users, illegal actions by third parties or actions without MIO3’s authorization, or force majeure/acts of God. In correct use cases, liability is limited to fees and charges paid for MIO3’s services.
15.2. Waivers/limitations of liability may not apply where prohibited by applicable law.
Direct Resolution
16.1. For disputes, the User should preferably contact MIO3 directly to discuss and resolve disagreements. If unresolved, the following clause applies.
Jurisdiction and Governing Law
17.1. These Terms are governed by the laws of the Republic of El Salvador. Disputes or claims will be resolved exclusively in the competent courts of El Salvador.
Severability
18.1. If any clause becomes or is deemed illegal, invalid, or unenforceable, it will be treated as unwritten or modified to be enforceable, without affecting the validity of the remaining clauses.
Language
19.1. These Terms may be translated; in case of inconsistency or ambiguity, the Spanish version prevails.
Notices
20.1. Notices will be sent only to the email the user provided upon registration; the user must keep it correct and updated. Notices are deemed valid upon receipt at that address.
Account Handling in the Event of the User’s Death
21.1. In the event of the account holder’s death, the provisions of El Salvador’s Civil Code on succession apply, solely regarding digital wallets in MIO3’s custody.
Acceptance of the Terms and Conditions of Use
By accepting these Terms, you acknowledge that you have read and understood their content and agree to be bound by them as established in Article 14 of the Electronic Commerce Law. If you do not agree or cannot comply, you may not use MIO3’s Services or access content.
These Terms govern the relationship between you and MIO3 and do not create rights in favor of third parties. If you do not comply and MIO3 does not act immediately, this does not imply a waiver of any rights.
